Rules & regulation
Is forex trading legal in Pakistan?
Last reviewed:
Short answer
Forex trading is legal in Pakistan when it goes through regulated channels: banks and exchange companies licensed by the State Bank of Pakistan (SBP), and SECP-regulated venues such as the Pakistan Mercantile Exchange (PMEX). Online offshore brokers are not regulated in Pakistan, and the SBP has called payments to some of them prohibited, so funding them is where the legal risk lies.
Who regulates forex in Pakistan
Two regulators share the ground. The State Bank of Pakistan controls foreign exchange itself under the Foreign Exchange Regulation Act, 1947 (FERA): who may buy and sell foreign currency, and for what purpose money may leave the country. The Securities and Exchange Commission of Pakistan (SECP) regulates securities and futures markets, the brokers who operate in them, and investor protection.
That split explains why the answer to "is forex legal?" depends on how you trade. Exchanging currency at a licensed bank or exchange company is ordinary and legal. Speculating on currency prices with leverage is legal only on a venue the SECP regulates.
The three legal routes
| Route | Regulator | What you can do |
|---|---|---|
| Banks and exchange companies | SBP | Buy and sell foreign currency for permitted purposes (travel, education, imports). |
| PMEX (Pakistan Mercantile Exchange) | SECP | Trade cash-settled futures, including selected currency pairs and gold, through a PMEX broker. |
| Roshan Digital Account (overseas Pakistanis) | SBP | Hold foreign currency and invest in Pakistani assets; not a vehicle for offshore speculation. |
What about offshore brokers like Exness, XM or OctaFX?
Most "forex trading" advertised to Pakistanis on social media is margin trading of CFDs with brokers registered abroad. These firms are not licensed by the SBP or the SECP. In a public advisory the SBP named OctaFX and Easy Forex, said transactions with such platforms are "prohibited and against laws of the land", and told banks to stop payments to them.
Opening an account abroad is not itself the problem; sending money to it is. Buying foreign currency from a bank or exchange company to fund an unauthorised platform breaches SBP rules, and card or wallet payments to these brokers can be blocked or flagged. If something goes wrong — a broker freezes withdrawals or disappears — no Pakistani regulator can help you recover the money.
How to check if a platform is legal before you deposit
- Search the broker's name on the SECP website and on PMEX's list of registered brokers.
- Check SBP and SECP press releases for warnings that name the platform.
- Be suspicious of anyone who promises fixed daily or monthly returns, asks you to pay through a personal JazzCash/Easypaisa account, or pays you for bringing in friends.
- Prefer platforms where your money is held in your own name with a regulated custodian.
Taxes on forex gains
Profits from futures traded on PMEX are taxable income in Pakistan, and brokers deduct or report tax under the Income Tax Ordinance. Gains made abroad by Pakistani residents are also taxable, whether or not the platform reports them. Tax rules change with each budget, so confirm the current rate with the FBR or a tax adviser before you file.
Roman Urdu mein jawab
Kya Pakistan mein forex trading legal hai?
Haan, lekin sirf regulated tareeqay se: SBP ke licensed banks/exchange companies aur SECP ke regulated PMEX ke zariye. Exness, XM, OctaFX jaise offshore brokers Pakistan mein regulated nahi hain, aur SBP ne kuch ko paisay bhejna 'prohibited' kaha hai. Masla account kholna nahi, balke us mein paisay bhejna hai.
Frequently asked questions
Is Exness legal in Pakistan?
Exness is not licensed by the SBP or the SECP. Using it is not specifically listed as a crime, but funding it through Pakistani banks or wallets can breach SBP foreign-exchange rules, and Pakistani regulators cannot help if a dispute arises.
Can I trade forex legally on PMEX?
Yes. PMEX is regulated by the SECP and lists cash-settled futures on selected currency pairs, gold and other commodities. You trade through a PMEX-registered broker after a KYC check.
Can a student or freelancer trade forex in Pakistan?
Anyone over 18 who passes a broker's KYC can open a PMEX account. Freelancers who earn in dollars should keep those earnings in proper bank accounts; moving them to unregulated platforms carries the same risks as for anyone else.
Will the government ban forex trading?
Regulated currency trading through banks and PMEX is a normal part of the financial system. What regulators act against is unlicensed brokers and schemes, usually through warnings and payment blocks.
